CLOSED SESSION PUBLIC COMMENT: Any member of the public wishing to address the City Council on any matter appearing on the closed session may do so at this time. Unless the Mayor Agenda City Council of the City of El Centro November 16, 2021 City of El Centro Page 2 extends the time limit, remarks shall be limited to three (3) minutes. Additional opportunities for Public Comments will be given during and at the end of the meeting.

CITY COUNCIL ADJOURNS INTO CLOSED SESSION CITY COUNCIL CLOSED SESSION LABOR NEGOTIATIONS The City Council will recess to closed session pursuant to Government Code §54957.6 to meet with Agency Representatives Marcela Piedra, City Manager, Dulce Bedolla, Interim Human Resources Director and Patrick Clark, consulting negotiator, for the purpose of considering employee compensation in the form of fringe benefits, or, as applicable, other matters dealing with mandatory subjects within the scope of representation pursuant to Government Code §3504; negotiating with all bargaining units within the City.

POSSIBLE LITIGATION INITIATED BY THE CITY A point has been reached where, in the opinion of the City Council upon the advice of its legal counsel, based upon existing facts and circumstances, there is a significant possibility of litigation initiated by the City under Govt. Code Section 54958.9(d)(4) - one case regarding code enforcement. EXISTING LITIGATION Upon advice of its legal counsel, the City Council will recess to closed session pursuant to Government Code §54956.9(d)(1) regarding the following existing two cases: (I) City of El Centro v. Was Fun Realty (Mayan Hotel); and (ii) States of California. Colorado, Connecticut, Delaware, Florida, Georgia, Louisiana, Massachusetts, New York, Ohio, Pennsylvania, and Texas et al v. Cardinal, McKesson, AmerisourceBergen and Johnson & Johnson (the opioid settlement).

NOTICE TO THE PUBLIC This is a public meeting. If there is an item on the agenda on which you wish to be heard, you are asked to complete a blue speaker slip and submit it to the City Clerk prior to the start of the meeting. Persons wishing to address the Council are not required to identify themselves (Gov’t Code § 54953.3); however, this information assists the Mayor by ensuring that all persons wishing to address the Council are recognized and also assists the City Clerk in preparing the City Council meeting minutes. When the item is announced and your name is called by the Mayor, please step to the podium and state your name for the record. Unless the Mayor extends the time, there is a three (3) minute time limit for each public presentation. 9. Adopt Resolution No. 21- , RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL CENTRO APPROVING A VENDOR AGREEMENT WITH AG TECH, LLC FOR BIOSOLIDS REMOVAL SERVICES RELATING TO THE BIOSOLIDS DISPOSAL PROJECT

10. Adopt Resolution No. 21- , RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL CENTRO APPROVING A VENDOR AGREEMENT WITH WEST COAST ARBORISTS, INC., FOR TREE MAINTENANCE SERVICES 6:30-7:20 NEW BUSINESS

11. Discussion and any necessary action regarding the approval of IID invoices for the relocation of certain power poles related to the Imperial Avenue Extension Project PRESENTATION: Abraham Campos, PE - Public Works Director/City Engineer RECOMMENDATION: Authorize the payment to IID in the amount of $1,779,964.83 for the relocation of power poles between Danenberg Avenue and Manuel Ortiz Drive related to the Imperial Avenue Extension Project, and appropriate $1,410,738.05 to Federal Highways Administration Fund 401

12. Discussion and any necessary action regarding the approval of a Task Order to Chen-Ryan On-Call Contract for engineering services related to the SR-86 proposed relinquishment. PRESENTATION: Abraham Campos, PE - Public Works Director/City Engineer RECOMMENDATION: Authorize the City Manager to enter into Task Order No. 3 of the Chen-Ryan OnCall Agreement in the amount of $231,811.20 for an independent analysis of the Caltrans SR-86 corridor proposed for relinquishment to the City of El Centro and authorize the use of Measure D funds towards said task order.

13. Discussion and any necessary action regarding the approval of a construction services agreement with A&R Construction for emergency water main repairs PRESENTATION: Abraham Campos, P.E. Public Works Director/City Engineer RECOMMENDATION: Adopt Resolution No. 21- , RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL CENTRO APPROVING A CONSTRUCTION SERVICES AGREEMENT WITH TERRY ROBERTSON, INC., DBA A&R CONSTRUCTION FOR EMERGENCY WATER MAIN REPAIRS AT THE EL CENTRO WATER TREATMENT PLANT

Discussion on the Establishment of Priorities for 2022-2023 Community Development Block Grant Funding Cycle PRESENTATION: Adriana Nava, Community Services Director RECOMMENDATION: Provide direction and/or recommendation as to what will be City Council's funding priorities for the Community Development Block Grant (CDBG) Program year 2022-2023

15. Presentation of Draft Strategic Planning 2022-2027 PRESENTATION: Marcela Piedra, City Manager RECOMMENDATION: Listen to draft Strategic Plan presentation and provide comments. Open public review period from November 17, 2021 to December 2, 2021.

16. Employment contract for Director of Human Resources PRESENTATION: Marcela Piedra, City Manager RECOMMENDATION: Adopt Resolution No. 21- , Resolution of the City Council of the City of El Centro establishing the compensation and employment terms for the position of Director of Human Resources

Employment Contract for City Manager, commencing January 3, 2022 PRESENTATION: Dulce Bedolla, Interim Human Resource Director RECOMMENDATION: Adopt Resolution No. 21- , RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL CENTRO ESTABLISHING THE COMPENSATION AND EMPLOYMENT TERMS FOR THE POSITION OF CITY MANAGER FOR JANUARY 3, 2022 THROUGH JANUARY 2, 2025. LEGISLATIVE ACTION
