CITY COUNCIL CLOSED SESSION ANTICIPATED LITIGATION A point has been reached where, in the opinion of the City Council upon the advice of its legal counsel, and based upon existing facts and circumstances, there is a significant possibility of initiation of litigation by the City pursuant to Govt. Code Section 54956.9(d)(4): two cases. POSSIBLE LITIGATION A point has been reached where, in the opinion of the City Council upon the advice of its legal counsel, and based upon existing facts and circumstances, there is a significant possibility that there will be litigation initiated against the City under Govt. Code Section 54956.9(d)(2) - one case based upon Ace bid protest. EXISTING LITIGATION A point has been reached where, in the opinion of the City Council upon the advice of its legal counsel, and based upon existing facts and circumstances, there is a need to discuss existing litigation to which the City is a party: City of El Centro v. LAFCO. NOTICE TO THE PUBLIC This is a public meeting. If there is an item on the agenda on which you wish to be heard, you are asked to complete a blue speaker slip and submit it to the City Clerk prior to the start of the meeting. Persons wishing to address the Council are not required to identify themselves (Gov’t Code § 54953.3); however, this information assists the Mayor by ensuring that all persons wishing to address the Council are recognized and also assists the City Clerk in preparing the City Council meeting minutes. When the item is announced and your name is called by the Mayor, please step to the podium and state your name for the record. Unless the Mayor extends the time, there is a three (3) minute time limit for each public presentation. If you wish to address the Council concerning any other matter not appearing on the agenda, you may do so during the public comment portion of the agenda. 16. Rejection of bid received for Traffic Striping Maintenance Contract PRESENTATION: Abraham Campos, PE - Director of Public Works / City Engineer RECOMMENDATION: Reject bid from Rove Engineering, Inc., for the Traffic Striping Maintenance City Wide Project

Approve Termination of Proclamation of Local Emergency for Tropical Cyclone Hilary PRESENTATION: Joseph Bernal, Fire Chief RECOMMENDATION: Adopt Resolution No. 23- , RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL CENTRO TERMINATING THE PROCLAMATION OF A LOCAL EMERGENCY FOR TROPICAL CYCLONE HILARY IN THE CITY OF EL CENTRO.

Discussion and Related Action Regarding Change Order #1 for Dog Park Project - Located at the Southeast Corner of Adams Avenue and 7th Street with Duggins Construction PRESENTATION: Adriana Nava, Community Services Director RECOMMENDATION: Approval of Change Order #1, which includes a Single Stall Restroom, and approve a budget amendment in the amount of $200,000 from the Debbie Pittman Lighting Field Project and allocation of the project savings to the Dog Park Project. Additionally, reallocate $23,550 from the Swarthout Park Field Lighting Project to the Dog Park Project.
