Unless the Mayor extends the time limit, remark shall be limited to three (3) minutes. Additional opportunities for Public Comments will be given during and at the end of the meeting.

POSSIBLE LITIGATION INITIATED BY THE CITY
A point has been reached where, in the opinion of the City Council on the advice of its legal counsel, based upon existing facts and circumstances, there is a significant possibility of initiation of litigation by the City under Govt. Code Section 54956.9(d)(4) against Surya Hospitality and/or Mahavir Hospitality for refusing easement access and over $500,000 owed in water and sewer capacity fees.

ANTICIPATED LITIGATION
Significant exposure to litigation against the City. A point has been reached where, in the opinion of the City Council on the advice of its legal counsel, based upon existing facts and circumstances, there is a significant exposure to litigation against the City under Govt. Code Section 54956.9(d)(2). There are 2 potential cases based upon a claim filed against the City by potential plaintiff Pedro Ponce based resulting from a traffic accident on a County road and William Hunter resulting from his vehicle hitting the median at Dogwood and McCabe.

PUBLIC SAFETY
Upon advice of its legal counsel, the City Council will recess to closed session pursuant to Government Code Section 54957(a) regarding matters posing a threat to the security of public buildings and essential public services and the public’s right of access to those. The Council also may consider the ability to discuss certain matters arising from the state of emergency pursuant to Govt. Code Section 54956.9(d)(3).
NEGOTIATIONS REGARDING ACQUISITION/DISPOSITION OF REAL PROPERTY - 3 Properties
The City Council will recess to closed session pursuant to Government Code §54956.8 to give instructions to the City’s negotiators, Marcela Piedra, City Manager, and Abraham Campos, Public Works Director for the following negotiations regarding real property for the Imperial Avenue Expansion which instructions will include price, terms of payment or both, including due diligence provisions and other monetary related considerations concerning purchase and sale of the property identified as follows: Susanna & Mincks Waterman Trust - APN 052-280-014 & 052-280-015; Grizzle Land and Development, LLC - APN 052-380-00; Maruti Construction and Management, LLC - APN 053-690-036

7. Discussion and any necessary action regarding appointments to the Library & Community Services Board.

RECOMMENDATION:
Mayors Recommendation: Appointments to the Library & Community Services Board for two (2) voting members with term ending on June 30, 2023 and two (2) non-voting members scheduled vacancies with term ending June 30, 2022.

8. Discussion and any necessary action regarding the appointment to the Imperial Valley Housing Authority.

RECOMMENDATION:
Mayors Recommendation: Appointment to the Imperial Valley Housing Authority with one (1) scheduled vacancy with term ending July 1, 2024.

9. Discussion and any necessary action to consider the cancellation of the City Council regular meetings of August 4, 2020 and August 18, 2020.
