CITY COUNCIL CLOSED SESSION EXISTING LITIGATION

Upon advice of its legal counsel, the City Council will recess to closed session pursuant to Government Code §54956.9(d)(1) regarding the following existing case to which the City is a party: Cazares v. City of El Centro POSSIBLE LITIGATION INITIATED BY THE CITY A point has been reached where, in the opinion of the City Council on the advice of its legal counsel, based upon existing facts and circumstances, there is a significant possibility of initiation of litigation by the City under Govt. Code Section 54956.9(d)(4): County tax and development fee allocation upon incorporation NEGOTIATIONS REGARDING ACQUISITION/DISPOSITION OF REAL The City Council will recess to closed session pursuant to Government Code §54956.8 to give instructions to the City’s negotiators, Marcela Piedra, City Manager, and Abraham Campos, Public Works Director for the following negotiations regarding real property for the Imperial Avenue Expansion which instructions will include price, terms of payment or both, including due diligence provisions and other monetary related considerations concerning purchase and sale of the property identified as follows: Maruti Construction and Management, LLC - APN's 053-690-036, 053-807-007 and 053-690-036 PUBLIC SAFETY Upon advice of its legal counsel, the City Council will recess to closed session pursuant to Government Code Section 54957(a) regarding matters posing a threat to the security of public buildings and essential public services and the public’s right of access to those. The Council also may consider the ability to discuss certain matters arising from the state of emergency pursuant to Govt. Code Section 54956.9(d)(3). NOTICE TO THE PUBLIC This is a public meeting. If there is an item on the agenda on which you wish to be heard, you are asked to complete a blue speaker slip and submit it to the City Clerk prior to the start of the meeting. Discussion and necessary action regarding the adoption of a resolution of necessity for the acquisition by eminent domain of real property located on 102 East Danenberg Drive, APN 054-050-008 PRESENTATION: Abraham Campos, PE - Public Works Director/City Engineer RECOMMENDATION: Adopt Resolution No. 20- , RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL CENTRO, CALIFORNIA, DECLARING THE PUBLIC INTEREST AND NECESSITY IN ACQUISITION BY EMINENT DOMAIN OF REAL PROPERTY LOCATED 102 EAST DANENBERG DRIVE, IN THE CITY OF EL CENTRO 6:40-7:10 NEW BUSINESS

Discussion and any necessary action regarding Measure P funding for Monte Vista Regional Soccer and Wellness Park CEQA fees PRESENTATION: Angel Hernandez, Associate Planner RECOMMENDATION: City Staff is requesting direction from City Council on utilizing up to $8,100 in Measure P funding previously allocated for the Monte Vista Needs Assessment and Feasibility Study to pay for City, County, and State fees related to CEQA documents for the ICOE Monte Vista Regional Soccer and Wellness Park project.

12. Discussion and any necessary action regarding the reduction of a certain bond related to the Imperial Valley Commons Project PRESENTATION: Abraham Campos, PE - Public Works Director/City Engineer RECOMMENDATION: Approve the reduction of bond No. 08854318 to $274,150 as recommended by staff.

13. Unmanned Aerial System (UAS) PRESENTATION: Deputy Chief Robert Sawyer RECOMMENDATION: The El Centro Police Department is seeking the support and endorsement of the City Council for the purchase and implementation of this program.

14. Discussion and any necessary action regarding the cancellation of the November 3, 2020 City Council/SA/SHA meeting. PRESENTATION: Efrain Silva, Mayor RECOMMENDATION: Council may select to cancel this meeting. Should a matter require immediate Council direction or action, a special meeting could be called.
