Unless the Mayor extends the time limit, remark shall be limited to three (3) minutes. Additional opportunities for Public Comments will be given during and at the end of the meeting.

CITY COUNCIL CLOSED SESSION EXISTING LITIGATION Upon advice of its legal counsel, the City Council will recess to closed session pursuant to Government Code §54956.9(d)(1) to receive its annual update regarding existing litigation to which the City is a party: Litigation against the City: Antonio Cruz v City of El Centro; Michael Loyd v. City of El Centro et al; Jason Cazares v. City of El Centro et al; Alexis Retana v. City of El Centro et al - Litigation Initiated by the City: City of El Centro v. Maruti Construction (eminent domain) City of El Centro v Madison Properties (code enforcement) POSSIBLE LITIGATION AGAINST THE CITY A point has been reached where, in the opinion of the City Council on the advice of its legal counsel, and based upon existing facts and circumstances, there is a significant possibility of initiation of litigation against the City under Govt. Code Section 54956.9(d)(2) based upon the following two unresolved claims. The first was filed by Stacey Verdugo and the second by Leonard Cortez. NEGOTIATIONS REGARDING ACQUISITION/DISPOSITION OF REAL PROPERTY The City Council will recess to closed session pursuant to Government Code §54956.8 to give instructions to the City’s negotiators, Marcela Piedra, City Manager, and Elizabeth Martyn, City Attorney, negotiating with a representative of Imperial Valley College regarding the lease of the real property located at 1998 N. 12th St. owned by the City to the Imperial Valley College Foundation, which instructions will include price, terms of payment or other monetary related considerations. PUBLIC SAFETY Upon advice of its legal counsel, the City Council will recess to closed session pursuant to Government Code Section 54957(a) regarding matters posing a threat to the security of public buildings and essential public services and the public’s right of access to those. The Council also may consider the ability to discuss certain matters arising from the state of emergency pursuant to Govt. Code Section 54956.9(d)(3). If there is an item on the agenda on which you wish to be heard, you are asked to complete a blue speaker slip and submit it to the City Clerk prior to the start of the meeting. Persons wishing to address the Council are not required to identify themselves (Gov’t Code § 54953.3); however, this information assists the Mayor by ensuring that all persons wishing to address the Council are recognized and also assists the City Clerk in preparing the City Council meeting minutes. When the item is announced and your name is called by the Mayor, please step to the podium and state your name for the record. Unless the Mayor extends the time, there is a three (3) minute time limit for each public presentation. 6. Public Hearing to solicit public input on the 2019-2020 Consolidated Annual Performance Evaluation Report (CAPER) and Approval of the CAPER and authorization for staff to submit the CAPER to the U.S. Department of Housing and Urban Development (HUD)

PRESENTATION: Stacy Mendoza, Economic Development Manager

RECOMMENDATION: 1) Open the Public Hearing and solicit public input on the 2019-2020 Consolidated Annual Performance Evaluation Report (CAPER), approve the CAPER, and authorize staff to submit the CAPER to the U.S. Department of Housing and Urban Development (HUD). 2) Adopt Resolution No. 20- , RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL CENTRO APPROVING THE CONSOLIDATED ANNUAL PERFORMANCE AND EVALUATION REPORT 2019 AS PART OF THE END OF THE YEAR REQUIREMENT REPORT PROVIDED TO THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT UNDER THE ENTITLEMENT GRANTEE PROGRAM 6:30-6:40

8. Discussion and related action regarding Lease Agreement and Regulatory Agreement with Imperial Valley College Foundation for Tiny Homes Project PRESENTATION: Adriana Nava, Community Services Director RECOMMENDATION: Approval of a Lease Agreement and Regulatory Agreement with the Imperial Valley College Foundation in a form acceptable to the City Manager and City Attorney for the Lotus Living, Rise Above, Resilient Community. 

9. Discussion on establishing priorities for 2021-2022 Community Development Block Grant Funding Cycle PRESENTATION: Stacy Mendoza, Economic Development Manager RECOMMENDATION: Direction and/or recommendation of City Council as to what will be its priority to fund under the Community Development Block Grant (CDBG) Program year 2021/2022.
