CITY COUNCIL ADJOURNS INTO CLOSED SESSION CITY COUNCIL CLOSED SESSION EXISTING LITIGATION

Upon advice of its legal counsel, the City Council will recess to closed session pursuant to Government Code §54956.9(d)(1) regarding litigation (i) against the City: Rosario Beltran v. City of El Centro, Heriberto Ocejo; Seventh Street Beauty Salon, and Sandra Garcia, ECU001656; and (ii) initiated by the City : City of El Centro v Madison Properties (eminent domain) POSSIBLE LITIGATION AGAINST THE CITY A point has been reached where, in the opinion of the City Council on the advice of its legal counsel, and based upon existing facts and circumstances, there is a significant possibility of initiation of litigation against the City under Govt. Code Section 54956.9(d)(2) based upon the following two unresolved claims: (i) Daniel Nava - pothole on Imperial Ave; (ii) Tania V. Guerrero - police officer chasing a private car, which car then hit her fence; and (iii) Kaleb Castillo, a minor, hit by a private car while riding his bicycle on a City street. POSSIBLE LITIGATION INITIATED BY THE CITY A point has been reached where, in the opinion of the City Council on the advice of its legal counsel, based upon existing facts and circumstances, there is a significant possibility of initiation of litigation by the City under Govt. Code Section 54956.9(d)(4): County tax and development fee allocation upon incorporation - South Dogwood Annexation PUBLIC SAFETY Upon advice of its legal counsel, the City Council will recess to closed session pursuant to Government Code Section 54957(a) regarding matters posing a threat to the security of public buildings and essential public services and the public’s right of access to those. The Council also may consider the ability to discuss certain matters arising from the state of emergency pursuant to Govt. Code Section 54956.9(d)(3).
