ANTICIPATED LITIGATION

Significant Exposure to Litigation Against the City. A point has been reached where, in the opinion of the City Council on the advice of its legal counsel, based on existing facts and circumstances, there is a significant exposure to litigation against the City. There are (2) two potential cases (Government Code Section 54956.9(d)(2).

NEGOTIATIONS REGARDING ACQUISITION/DISPOSITION OF REAL PROPERTY

The City Council will recess to closed session pursuant to Government Code
§54956.8 to give instructions to the City’s negotiator, Marcela Piedra, Deputy
City Manager and Abraham Campos, Deputy City Engineer
, regarding negotiations with Puente del Sol, LLC instructions will concern price, terms of payment or both, including use restrictions, development obligations and other monetary related considerations concerning the purchase, sale, exchange and/or lease of the property known as APN 064-470-105-000.

The City Council will recess to closed session pursuant to Government Code
§54956.8 to give instructions to the City’s negotiator, Marcela Piedra, Deputy
City Manager and Abraham Campos, Deputy City Engineer
, regarding negotiations with George Amaral, as Trustee of the George Amaral Living Trust, dated 11-10- 93 instructions will concern price, terms of payment or both, including use restrictions, development obligations and other monetary related considerations concerning the purchase, sale, exchange and/or lease of the property known as APN 052-793-008 and APN 052-793-009.

PERSONNEL MATTERS

The Council will recess to closed session pursuant to Government Code Section 54957 to consider the evaluation of the performance of the City Attorney, City Clerk, and the Deputy City Manager.

Introduce Ordinance No. 17- , AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EL CENTRO AMENDING CITY CODE SECTIONS 29-53 OF DIVISION 2, 29-61 OF DIVISION 3, 29-69 OF DIVISION 4, 29-77 OF DIVISION 5 OF CHAPTER 29 RELATING TO COMMERCIAL CANNABIS (BOTH MEDICINAL AND NONMEDICINAL) LAND USES, AND REPEALING CERTAIN SECTIONS RELATED THEREOF, waive reading and approve as first reading and authorize City Clerk to place on the next agenda for second reading and adoption.

15. Public Hearing for Zoning Ordinance Text Amendment 17-06 - Amendment to Chapter 29 "Zoning" relating to R1 Minimum Lot Area

Introduce Ordinance No. 17- , AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EL CENTRO AMENDING CITY CODE SECTIONS 29-52 AND 29- 54.1 OF DIVISION 2, ARTICLE II, SECTION 29-107 OF DIVISION 2, ARTICLE III, CHAPTER 29, AND 29-162(1) OF DIVISION 9, ARTICLE III, CHAPTER 29 OF THE EL CENTRO MUNICIPAL CODE TO ALLOW A REDUCTION IN THE MINIMUM LOT AREA IN THE R1, SINGLE-FAMILY RESIDENTIAL ZONE, waive reading and approve as first reading and authorize City Clerk to place on the next agenda for second reading and adoption.
