EXISTING LITIGATION
Upon advice of its legal counsel, the City Council will recess to closed session pursuant to Government Code Section 54956.9 (d)(1) to confer with its attorney regarding existing litigation which has been initiated formally and to which the Agency is a part. The titles of the existing litigations are City of El Centro v. Charter Communications, Imperial County Superior Court, ECU 000275, remanded to the Southern District of the Federal court along with Charter Communications v. City of El Centro, 18cv679-AJB-NLS.
ANTICIPATED LITIGATION
Significant Exposure to Litigation Against the City pursuant to Govt. Code Section
54956.9(d)(2). A point has been reached where, in the opinion of the City Council on
the advice of its legal counsel, based on existing facts and circumstances, there is
significant exposure to litigation against the City. There is one (1) potential case.
Litigation by the City pursuant to Govt. Code Section 54956.9(d)(4) - there are four (4) potential cases.
LABOR RELATIONS NEGOTIATIONS
The City Council will recess to closed session pursuant to Government Code §54957.6 to meet with Agency Representatives Marcela Piedra, David Ritchie, Cota Cole & Huber and Teri Brownlee, Human Resources Director for the purpose of reviewing the City’s position and instructing its representative(s) regarding matters of salaries, salary schedules, compensation paid in the form of fringe benefits, or, as applicable, other matters dealing with mandatory subjects within the scope of representation pursuant to Government Code §3504; negotiating with All Department Heads, All Unrepresented Units, All Bargaining Units.
NEGOTIATIONS REGARDING ACQUISITION/DISPOSITION OF REAL PROPERTY
The City Council will recess to closed session pursuant to Government Code §54956.8 to give instructions to the City’s negotiator, Marcela Piedra,
City Manager, regarding negotiations with James and Cecelia Roach and ECRMC; those instructions will concern price, terms of payment or both, including use restrictions, development obligations and other monetary related considerations concerning the purchase, sale, exchange and/or lease of the property known as 1455 Pepper, El Centro, CA 92243.
The City Council will recess to closed session pursuant to Government Code §54956.8 to give instructions to the City’s negotiator, Marcela Piedra, City Manager, regarding negotiations with El Centro Medical Center, which instructions will concern price, terms of payment or both, including use restrictions, development obligations and other monetary consideration concerning the purchase, sale, exchange and/or lease of the property known as Parcel 2 of Valley Center Plaza.

4. Approve City Council/SA/SH minutes for regular meetings of April 3, 2018 and April 17, 2018.
5. Authorize the filing of the fiscal year 2017-2018 claims with Imperial County Transportation Commission (ICTC) for Public Transportation pursuant to: 1. Article 8(e) of the Public Utilities code for bus benches/shelter in the amount of $18,774. 2. Article 8(e) of the Public Utilities code for 7th/State Street bus terminal in the amount of $45,000. 3. Article 8(e) of the Public Utilities code for regional maintenance and upkeep benches/shelter in the amount of $25,000 4. Article 3 of the Public Utilities code for bicycle and pedestrian facilities in the amount of $35,782.

12. Public hearing to consider the recommendation of the Planning Commission on Sign Ordinance Text Amendment 18-01. The project proposes modifications to Chapter 22.1 "Signs" of the El Centro Municipal Code relating to the maximum height and area of freestanding signage on properties abutting Interstate 8 and the maximum number of freestanding signage in commercial and industrial centers.

RECOMMENDATION:
Approve Ordinance No. 18- , AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EL CENTRO AMENDING CHAPTER 22.1 OF THE EL CENTRO MUNICIPAL CODE REGARDING FREEWAY ORIENTED SIGNS AND FREESTANDING SIGNS IN COMMERCIAL AND INDUSTRIAL CENTERS, waive reading and approve as first reading and authorize City Clerk to place on the next agenda for second reading and adoption.
